Subject: Refund due to restricted use of chartered sailing yacht (October 18–25, 2025) Dear Sir/Madam, we chartered a sailing yacht in Pozzuoli through your company for the period October 18–25, 2025. On the day of check-in, October 18, 2025, we received the following WhatsApp message from the charter company: “🐢 Hello turtles 🐢 Due to the weather conditions and the end of the season, sailing outside our coast is forbidden, and it means no sailing to Ventotene, Ponza, and Palmarola. Sure you're going to understand, we wish you fair winds!” At that time, the weather forecast indicated no bad weather, and there were no warnings or restrictions from official authorities. According to our charter agreement, sailing is permitted at any time up to wind force 6 Beaufort. The "end of the season" was already known at the time of booking and, in our view, cannot constitute a valid reason for a subsequent restriction. We booked the yacht a year in advance, specifically with the intention of visiting Ponza and the surrounding islands. These destinations were crucial to our booking decision. Had we been aware of this restriction beforehand, we would not have chartered the yacht. Since the imposed sailing ban deprived us of significant portions of the agreed-upon use, we request a partial refund of 2/7 of the charter price. In our opinion, there was no objective or safety-related reason to prohibit us from sailing on the islands. We therefore request a response and a refund of the corresponding amount within 14 days.
